Standard terms for using ESS websites and services.

Product-specific terms take precedence.

These are the standard terms of Eireann Software Services, founded and owned by Jason Doyle ("ESS," "we," "us," or "our"). BarnPage, Briefena, and future ESS products may publish additional or different terms. Where product-specific terms conflict with these standard terms, the product-specific terms control for that product.

1. Acceptance and scope

These terms apply to eireannsoftwareservices.com and to ESS services that refer to them. By accessing or using a covered website or service, you agree to these terms. If you use a service for an organisation, you confirm that you have authority to bind that organisation.

2. Eligibility and accounts

You must be legally able to enter into a binding agreement in your location. Where an account is required, you are responsible for accurate registration information, safeguarding your credentials, and activity under your account. Tell the relevant product support team promptly if you believe an account has been compromised.

3. Products and service descriptions

We aim to describe each product, plan, price, capability, and material limitation accurately on its product site. Features may differ by plan and may change as products develop. Product-specific documentation and plan pages form part of the applicable service description.

4. Purchases and Paddle

Some ESS products use Paddle to process purchases, subscriptions, taxes, invoices, and billing support. For those orders:

Our order process is conducted by our online reseller Paddle.com. Paddle.com is the Merchant of Record for all our orders. Paddle provides all customer service inquiries and handles returns.

The product and price shown at checkout, Paddle's buyer terms, and any product-specific commercial terms also apply. You will have an opportunity to review the order before completing payment. Paddle may collect and process billing information under its own privacy notice.

5. Subscriptions and renewal

When you purchase a subscription, the billing interval and price are shown before checkout. Unless cancelled, subscriptions renew automatically at the then-applicable interval and price disclosed to you. You can stop future renewals through the product's billing portal or the cancellation route provided with your purchase. Cancellation does not remove access already paid for unless the product states otherwise.

6. Refunds

Our standard refund policy provides a 30-day request window. A product-specific refund policy takes precedence where published. Nothing in these terms limits non-waivable consumer rights.

7. Acceptable use

You may not use a covered website or service to:

  • break the law, infringe rights, or facilitate harm;
  • gain unauthorised access to accounts, systems, or data;
  • introduce malware or interfere with availability or security;
  • scrape, probe, reverse engineer, or overload a service except where law expressly permits;
  • misrepresent identity, affiliation, product output, or the source of information; or
  • resell or commercially exploit a service unless a written agreement allows it.

8. Intellectual property

ESS and its licensors retain all rights in the company website, product software, branding, documentation, and other service materials. Subject to the applicable plan and these terms, we grant you a limited, non-exclusive, non-transferable right to use the service for its intended purpose while your access remains valid.

9. Your content and feedback

You retain ownership of content you submit to a product. You grant ESS the limited rights needed to host, process, transmit, and display that content to provide and secure the service. Product-specific terms may explain these rights in more detail. If you voluntarily provide feedback, we may use it without restriction or compensation.

10. Third-party services

Products may depend on or link to third-party services. Their terms and privacy notices govern their services. ESS is not responsible for third-party services outside our control, but we remain responsible for our own contractual obligations.

11. Availability and changes

We work to operate reliable services but do not promise uninterrupted or error-free availability. Maintenance, security work, provider outages, and events outside reasonable control may affect access. We may modify or discontinue features and will provide notice where required by law or an applicable product agreement.

12. Disclaimers

To the maximum extent permitted by law, covered services are provided "as is" and "as available." ESS disclaims implied warranties of merchantability, fitness for a particular purpose, and non-infringement. Product output is informational and does not replace legal, medical, financial, veterinary, safety, or other regulated professional advice.

13. Limitation of liability

To the maximum extent permitted by law, ESS will not be liable for indirect, incidental, special, consequential, or punitive damages, or for lost profits, revenue, goodwill, or data. ESS's total liability for a claim relating to a paid service will not exceed the amount you paid for that service during the 12 months before the event giving rise to the claim. These limits do not apply where liability cannot legally be excluded or limited.

14. Suspension and termination

You may stop using a service at any time and may cancel a subscription as described above. We may suspend or terminate access for material breach, security risk, unlawful use, or non-payment, subject to applicable law and product-specific terms. Provisions that by their nature should survive termination will survive.

15. Governing law

These standard terms are governed by the laws of the State of Washington, without regard to conflict-of-law principles. Courts with jurisdiction in Washington State will have jurisdiction over disputes, except where mandatory consumer law provides otherwise.

16. Changes to these terms

We may update these terms to reflect changes in our services, law, or operations. The effective date above identifies the current version. We will provide additional notice where a material change requires it.
